The one story building was built between 1940 and 1952. The building is of frame and masonry construction and is irregularly shaped. It is oriented linearly with most of its frontage along Auburn Avenue , and one entry facing Resort Street . It has been divided into 4 suites. Hairitage Beauty Salon occupies the “front” suite facing Resort Street . The 3 other tenants are CAM Credit Bureau, a Curves franchise and Therapeutic Massage, which are accessed from the parking lot off of Auburn Avenue. The current leases reportedly total $2,030.00 per month, with landlord/ mortgagor paying electrical, gas, water, sewer and garbage, and taxes (unpaid, see below).

The property which will be sold at foreclosure consists of “land in M.E. PLACE ’S ADDITION, consisting of the north 74 feet of lots 1, 2, and 3, and all of lot 4, in Block A.” Lot 4 extends all the way to the Powder River , and is considerably larger than lots 1, 2, and 3.  The parking lot on the south adjoining property appears to be used by customers of the tenants of the property.

Property taxes have not been paid on the property since 1999. Past due taxes and penalties through 2003 total almost $15,000.  Because Mortgagee will be paying past due taxes and other foreclosure-related expenses (anticipated in the $25,000 range), any winning bid of less than the amount of these expenses would be subject to bidder paying off all these expenses in cash in addition to their winning bid.

The out of state lending institution which has the mortgage on this property has ordered the foreclosure of the loan on Monday, April 26th at 1:00 PM at the Baker County courthouse steps, less than 3 blocks from the property. The lender does not intend to have to credit bid on the property, as they only require the amount necessary to pay past due taxes and expenses related to the foreclosure.

DIRECTIONS TO THE PROPERTY: From I-84, exit 304 in Baker City , go west on Campbell Street to Resort Street , then south on Resort Street to Address.

DIRECTIONS TO THE COURTHOUSE STEPS ( SALE SITE): From the property, it’s a short walk west on Auburn Avenue, north on 3rd to Courthouse (corner of Washington ).

PROPERTY INSPECTION: The staffed property inspection will be held Wednesday, April 21st, from 10:00 AM until 5:00 PM . Other inspections can be arranged by appointment; call Rich Pickett at (208) 250-4767.

AUCTION REGISTRATION: Auction registration will begin 1 hour before the auction. You must bring a combination of cashiers or bank certified checks and cash sufficient to pay your total bid amount in cash or cash equivalent if you are the high bidder at the foreclosure sale. The cashiers checks and/or bank certified checks should be payable to yourself, and will be endorsed to the Trustee overseeing the auction if you are the winning bidder.  You must present evidence of cash equivalents to auction representatives in exchange for a bid card, which will be required to bid at the foreclosure auction. We recommend that bidders bring cashiers checks and cash in various amounts in anticipation of paying the price you wish to pay. For example, if you anticipate paying around $100,000, then you should probably bring 5 cashiers checks in the amount of $20,000 each, plus cash or cashiers checks in various smaller denominations so that your final bid (higher or lower) is covered in cash.


TERMS OF SALE : The high bidder will pay the entire amount of their winning bid in cash, cashiers checks, or bank certified checks immediately after the auction. Any cashier’s or bank certified checks made by the winning bidder will be immediately endorsed to the Trustee. Conveyance will be by Trustee’s deed within 10 days of the auction. The Mortgagee will pay all past due taxes and expenses of the foreclosure, provided total amount bid exceeds foreclosure expenses, estimated at $25,000. If winning bid is less than the amount required, winning buyer must pay additional amount required to pay all expenses incurred, in cash, at the time of sale. Current year taxes are the responsibility of the winning bidder.

Property sells As Is - Where Is with no warranties expressed or implied. Each potential bidder is responsible for conducting their own independent inspections, investigation, inquiries, due diligence, tests, surveys and other studies concerning the property, prior to the auction.  It is purchaser's responsibility to verify all information provided herein. All property sold is subject to recorded easements which include existing roads and planned roads, power line and other utility easements, ingress and egress easements, and other easements of record.
